Discussion on accepting the resignation of the former legal counsel Marc Lyons. Trustee McKenzie expressed dismay that Lyons refused to offer client attorney privilege to him or Banducci but offered it to the three appointed trustees. NIC President Swayne says that the governor office called him and said that if a resolution is not part of the meeting packet then Idaho open meeting law was violated. McKenzie mentions that the appointed board members did the same thing and no one mentioned the law was being violated then. Swayne goes on to say that legal counsel needs an RFP. Banducci mentions that Lyons legal services didn't have an RFP. Wold keeps mentioning the Kootenai County Republican Central Committee in his remarks. He names the three candidates who the KCRCC recommends. He says they are too new and think too much alike. Um, the same could be said about the three candidates he supports. Wold demands Trustee McKenzie's microphone be turned off due to Mckenzie interrupting to point out where Wold is wrong. Wold says that he is scared of Banducci reversing things that the board has done in the last few months. Wold says, “Respect the majority decisions of the board.” I would agree if the board was all elected. It is hard to have confidence in appointed trustees. Hayden City Councilman DePriest talked about supposed deliberate misinformation at the 9/13 Hayden City Council Meeting. He says that he likes to interact with people on line to lend a second opinion. He claims that lots of blocking and censorship has been happening on local Facebook pages and groups. What he failed to mention is that he is intolerant of other opinions. Other opinions are not misinformation. When Ed was on the Facebook group Responsible Growth North Idaho he would block and censor opinions he didn't like. He also tried to shut down the group once he took office even though he was not the one to create it. Ed doesn't want a debate or conversation in my opinion, that is why he is blocked from the Bushnell Report. Another Taskforce member has also been blocked. Notice the dig against Councilwoman White. Doug O. is an Idaho State Representative who gave public comment regarding the potential 50 year lease being proposed at the CDA airport. He stated that he sent all three commissioners an email about the lease and his concerns. Doug stated that he talked with the Chief Deputy in the Idaho Attorney Generals office about his concerns regarding this lease. Doug says that the Chief Deputy AG was not sure if the county has the authority to do a 50 year lease. He also expressed that the AG's office thinks that this should be open to a competitive bidding process. Doug also mentioned something about a Constitutional issue regarding the lease. He mentioned Article 12 Section 4. "Is the county providing aid?" ( I am not sure what that means and have asked Doug to clarify what he meant. Here are the public comments/thoughts of the Kootenai County Commissioners regarding a new lease at the Coeur d'Alene airport. Commissioner Brooks thinks that the people are trying to make the airport lease a problem. He said, " This is a lease and should be treated as such. Like other people who have leases out there. We shouldn't ask for financials or a business plan from anyone wanting a lease.": Commissioner Duncan said, "I would agree with you Bill (Brooks) if this was an aeronautical lease without revenue sharing. Also, it is a 50 year lease, not a 25 year lease like the other leases at the airport." Commissioner Filios said he is more comfortable with a 25 year lease with an option to renew. Revenue sharing is not going to work in his opinion. He stated that this needs to be a simple lease. "We need to remove the Bank of China from the picture. A presentation of all the art pieces being recommended by the CDA arts commission happened first. Council member Evans asked the presenter to explain the process for the arts commission to recommend art to the city council. She stated she would be happy to recommend anyone if they are interested in being on a committee. Council member Mcevers asks if we are buying the pieces. It is stated that the prices are what the artists thinks it is worth, and that the city is not paying for the pieces. Council member English asks why these weren’t on the webpage before being brought before the council. (Good point.) Council member Wood states that she is uncomfortable with 7 people telling the community what to look at. Lynda states that the fist statue is a communism symbol more than solidarity. She then quotes CDA City Council member Amy Evans from a video from the CDA Arts commission meeting. Evans said she was energized by the statue. Lynda mentions that Dan Enligsh wants us to respect the arts commission. She asks, "How about respecting the oppressed and the citizens of cda?" And she says shame on the arts commission for even bringing this piece of art to be voted on. The fist statue proposed by the City of Coeur d'Alene Arts Commission was not approved. Thank you to all that emailed regarding this. If you didn't watch the video of the meeting, you should. Very good public comment. Additionally, Jennifer Drake, the head of the Art Commission spoke about the fist statue during public comment. I will post video clips from the meeting in the next few days. Apparently Drake can disparage the whole audience at the city council meeting and not be admonished. When the next person giving public comment disparaged Drake in her remarks, Hammond admonished her to the point where he asked the CDA police to get involved. Mayor Hammond refused to let anyone give public comment unless they wrote their address down on a sign up sheet for public comment. North Idaho College Trustees discuss the NIC President Candidate dinners. The video starts off with a discussion of informal dinner innovations for trustees. Trustee Wold and McKenzie are disagreeing. Wold state that only 2 trustees can be at a candidate dinner per legal counsel. There are concerns about 3 trustees at a dinner with a candidate. Apparently Trustee McKenzie showed up at a candidate dinner where two other trustees had been invited. Future dinners with candidates were cancelled due to legal counsel concern. Trustee Banducci asks if the candidate dinners are still up for discussion or if a decision has already been made. Trustee Wold says that a decision has been made. Banducci points out this is counter to what has been decided previously. He says that it was agreed to in writing with the search agency that all 5 trustees should dine with candidates. Now we will have 1 candidate who had a dinner with trustees and three candidates that won’t be able to do that. Banducci expressed his concern about inconsistencies. Trustee Wold says he appreciates Banducci's comments. Wold states that Trustee McKenzie broke protocol thus the cancellation of the dinners with candidates. Trustee Banducci says that is bullshit. "You guys broke protocol by not have all 5 trustees at the dinner. You guys are cheapening this process." Trustee McKenzie says he was never consulted about the dinners. He states that Trustee Wold chose who goes to the dinner. Wold states he did not make that decision. This video is 1 hour and 44 minutes. ES&S presented information about themselves and then took questions from the audience. Idaho Secretary of State employee also answered questions. Chris Wlaschin and Brandon Clifton were the main speakers from the vote tabulating company - ES&S ( Election Systems & Software). I don't agree with their statement right off the bat that they are our servants. They are a for-profit business. Here are my notes and opinions on the presentation by ES&S - the company that makes and maintains the vote tabulating machines for Kootenai County. Two things I noticed right away during their presentation: 1) Brandon Clifton from ES&S came across as disingenuous when presenting, 2) Chris Wlaschin trusts the federal government. According to the ES&S facts sheet handed out at the Tuesday elections office meeting: - The federal government tests the tabulation machines. (Hardware and software). Why? Why does the federal government need to do testing? Why are they involved? - The tabulating machines are windows based. Why? Tech notes: Windows 10, LTXE, Linx, BUTA, 256 encryption, firmware is done in house. Chips from IBM and Texas Instruments. Shipped from Mexico and/or Taiwan. - They background check regularly their employees and contractors they work with. - Per ES&S the two weakest points are when data is transferred, and absentee ballots. - 3 people do updates on tabulating software/maintenance/patches. Always observed. I asked how many people are involved with the hardware and software for the tabulating machines from beginning to end. ES&S has 225 employees in Omaha, Nebraska. Development is about 100 people split into voter registration, vote tabulation, and poll books. There is no connection with the internet at their company, only computer networking within their building. Quality Assurance team has 10 people. Certification team has 8 people. All hardware and software goes to be tested by the federal government and/or a third party company. That is done in Colorado (75 people) or Huntsville (30 people) Then an escrow agent gives the software to the state of Idaho. So about 350 people are involved in the making and testing of the tabulation machines. The question was asked, “Why the switch from hand count to machines?” ES&S said that in 2006 the federal government funded tabulating machines. They also mentioned time, cost, social influence - want results quicker. Security partnerships ES&S have: DHS, FBI, and the U.S. Intelligence Community to name a few. Some interesting from the representative from the Idaho Secretary of State: - Per Idaho law there are no modems in the tabulating machines. But it is legal to have modems in them in some states mostly in ES&S 200’s. ES&S says that 10% of tabulating machine can communicate by modem per request from the States that want the modem in them. - Idaho uses a Verizon zero-tunnel when the clerks office submits the pdf of the preliminary results to the Idaho Secretary of State. - There no law allows citizens to audit/inspect voting technology. The law needs to be changed to be able to do that. - Forensic Audit needs to be built in and have a standard. The law in Idaho needs to be changed to require a post-election audit. - New election audit standards just became law in 2022 for Idaho. If a county has over 100,000 people - it is more likely to be audited. Ada, Canyon and Kootenai. Ada is mostly likely to get audited next canyon, then Kootenai. 20,000 to 100,000 people counties - 8 of them. 3 out of 8 will be likely to be audited. Under 20,000 people counties - there are 3. Two counties are not included in the audit. Canvas and Clark counties. They hand count, and have 300-400 people per county. - They think that registration to vote is the weak point. - Voter information is retained for 22 months in Idaho. Digital is wiped by DOD cleaning software. Paper ballots are then shredded. - Current Kootenai County Clerk Jim Brannon has asked for 3 people to be prosecuted for election fraud in his nine years as clerk. Only one was actually prosecuted. Why is the federal government involved in state elections at all?
